Driving While License Cancelled, Suspended or Revoked (DWLS)

Florida law defines the crime of Driving While License Cancelled, Suspended or Revoked as:
(a) Driving a motor vehicle in the State; while
(b) Knowing that your license or privilege is cancelled, suspended or revoked.

Section 322.34 of the Florida Statutes.
Penalties for Driving While License Cancelled, Suspended or Revoked:
  • Driving While License Cancelled Suspended or Revoked is a misdemeanor of the second degree, punishable by up to 60 days in the county jail & a $500 fine. Section 322.34(2)(a) of the Florida Statutes.
  • A second or subsequent offense is a misdemeanor of the first degree, punishable by up to 1 year in the county jail & a $1,000 fine. Section 322.34(2)(b)(1) of the Florida Statutes.
  • A person convicted a third or subsequent time must serve a minimum of 10 days in jail. Section 322.34(2)(b)(2) of the Florida Statutes.
  • A third or subsequent offense can be charged as a felony of the third degree if the underlying suspension, cancellation or revocation resulted from a DUI, Refusal to Submit to Testing, Fleeing to Elude, or any traffic offense causing death or serious bodily injury. A felony conviction under this law is punishable by up to 5 years in prison. Section 322.34(2)(c) of the Florida Statutes.
Habitual Traffic Offender Considerations:
  • Depending on your driving history, a conviction for Driving While License Cancelled, Suspended or Revoked can cause you to be designated as a "habitual traffic offender", resulting in a minimum 5-year suspension of driver's license.

Felony for Habitual Traffic Offenders:
  • Any person who (1) has been designated a habitual traffic offender; AND (2) drives any motor vehicle in Florida while designated as a habitual traffic offender commits a felony of the third degree, punishable by up to 5 years in prison and no more than a $5,000 fine.
