Racing on a Highway
Florida law defines Racing on a Highway as:
(a) Driving a motor vehicle in; 
(b) Participating in, coordinating, facilitating, collecting money for; 

(c) Knowingly riding as a passenger in;
(d) Purposefully impeding traffic for;
(e) Operating a motor vehicle for the purpose of filming or recording; OR
(f) Operating a motor vehicle carrying fuel for the purpose of fueling a vehicle involved in; 
A race.

Penalties for Racing on a Highway:
  • Racing on a Highway is a misdemeanor of the first degree, punishable by up to 1 year in the county jail & a fine of at least $500 but no more than $1,000. A conviction will also result in a 1-year suspension of your driver's license. Section 316.191(3)(a) of the Florida Statutes.
  • A second violation within 5 years comes with a fine of at least $1,000 but no more than $3,000. A second conviction within 5 years will also result in a 2-year suspension of your driver's license. Section 316.191(3)(b) of the Florida Statutes.
  • A third violation within 5 years comes with a fine of at least $2,000 but no more than $5,000. A third conviction within 5 years will also result in a 4-year suspension of your driver's license. Section 316.191(3)(c) of the Florida Statutes.
